Zenaviq (“we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal data when you use https://learning.zenaviq.com. It is designed to be consistent with India’s Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology Act, 2000 and its rules. If you access the Platform from outside India, you consent to the processing of your data as described here.

1. Who We Are (Data Fiduciary)

2. Personal Data We Collect

Information you provide directly:

  • Account data: name, email address, password (stored in hashed form).
  • Purchase data: billing name, billing address, and transaction records. Note: payment card and banking details are collected and processed directly by our payment processors (Razorpay, PhonePe, Paytm, PayU, Stripe, and PayPal); we do not store your full card or bank account numbers.
  • Profile data: any optional information you add to your profile.
  • Communications: messages, support requests, and correspondence you send us.
  • User Content: comments, questions, answers, and reviews you post.

Information collected automatically:

  • Usage data: courses accessed, lessons viewed, quiz attempts and scores, progress, completion, and certificate issuance.
  • Technical data: IP address, browser type, device type, operating system, referring URLs, and general location (city/country level).
  • Cookies and similar technologies: see Section 8.

Information from third parties:

  • Data from our payment processor confirming transaction status.
  • Data from analytics and hosting providers.
  • If you register or log in via a third-party service (if offered), the data that service shares with us.

We do not intentionally collect sensitive personal data, and we ask that you do not submit health, patient, biometric, financial account, or other sensitive or confidential data through course exercises, comments, or support channels.

3. How We Use Your Personal Data

We use your personal data to:

  • create and manage your account;
  • process purchases, deliver course access, and issue certificates;
  • provide, maintain, and improve the Platform and our courses;
  • track your learning progress and quiz results;
  • respond to your enquiries and provide customer support;
  • send you transactional communications (purchase confirmations, account notices, course updates);
  • send you marketing communications where you have consented or as permitted by law (you can opt out at any time — see Section 9);
  • detect, prevent, and address fraud, abuse, security issues, and violations of our Terms;
  • comply with legal obligations and enforce our agreements;
  • analyse usage to understand and improve engagement (in aggregated or de-identified form where possible).

4. Legal Basis for Processing

Under the DPDP Act, we process your personal data on the basis of:

  • Your consent, which you provide when you create an account, make a purchase, or opt in to communications; and/or
  • Legitimate uses permitted under the Act, such as processing necessary to provide a service you have requested, to comply with law, or for other purposes expressly permitted.

You may withdraw consent at any time (see Section 9); withdrawal does not affect processing already carried out, and may limit our ability to provide certain services.

5. How We Share Your Personal Data

We do not sell your personal data. We share it only as follows, with Data Processors acting on our instructions:

  • Payment processor (our payment processors (Razorpay, PhonePe, Paytm, PayU, Stripe, and PayPal)) — to process payments.
  • Hosting and infrastructure providers — to operate the Platform.
  • Learning management / course platform provider — to deliver course functionality.
  • Email and communication providers — to send transactional and (where consented) marketing messages.
  • Analytics providers — to understand usage.
  • Professional advisers (lawyers, accountants, auditors) — where necessary.
  • Authorities and legal successors — where required by law, court order, or in connection with a merger, acquisition, or sale of assets.

We require our Data Processors to protect your data and use it only for the purposes we specify.

6. Data Transfers

Zenaviq Solutions serves customers worldwide, and our service providers (including international payment processors such as Stripe and PayPal, and hosting/email/analytics providers) may store or process data on servers located in India, the United States, the European Union, or other countries. By using the Platform and making a purchase, you consent to the transfer, storage, and processing of your personal data in these locations. Where data is transferred across borders, we take reasonable steps to ensure it is handled consistently with this Policy and applicable law, and we will not transfer data to any country restricted by the Government of India under the DPDP Act. If you are located in a jurisdiction with its own data-protection law (such as the EU/UK GDPR), you may have additional rights under that law; contact us to exercise them.

7. Data Retention

We retain your personal data only as long as necessary for the purposes described in this Policy, including:

  • account and learning data — for as long as your account is active, and for a reasonable period afterwards to support re-enrolment, certificate re-issuance, and record-keeping;
  • transaction and tax records — for the period required by Indian tax and accounting law;
  • data required for legal compliance or dispute resolution — for as long as necessary.

When data is no longer required, we delete or anonymise it.

8. Cookies and Tracking Technologies

We use cookies and similar technologies to:

  • keep you logged in and maintain your session (essential cookies);
  • remember your preferences (functional cookies);
  • understand how the Platform is used (analytics cookies).

9. Your Rights

Subject to applicable law (including the DPDP Act), you have the right to:

  • Access the personal data we hold about you and information about its processing;
  • Correct inaccurate or incomplete data;
  • Erase your personal data where it is no longer necessary or where you withdraw consent (subject to legal retention requirements);
  • Withdraw consent to processing at any time;
  • Grievance redressal — raise concerns with our Grievance Officer;
  • Nominate another individual to exercise your rights in the event of death or incapacity, as provided under the DPDP Act.

To exercise any right, contact us at info@zenaviq.com or our Grievance Officer (Section 12). We will respond within the timeframe required by law. We may need to verify your identity before acting on a request.

10. Data Security

We implement reasonable technical and organisational security measures to protect your personal data, including encryption in transit (HTTPS/TLS), hashed password storage, access controls, and use of reputable processors. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

In the event of a personal data breach, we will notify the Data Protection Board of India and affected users as required by the DPDP Act.

11. Children’s Privacy

The Platform is intended for users aged 18 and above. We do not knowingly collect personal data from children under 18 without verifiable parental or guardian consent, as required by the DPDP Act. If you believe we have collected data from a child without appropriate consent, contact us and we will delete it.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Effective date” reflects the latest version. Material changes will be notified via the Platform or email where reasonable. Please review it periodically.
